(Part 1)"},"content":{"rendered":"<p><strong>Control Over Idaho Water \u2013 Part 1<\/strong><\/p>\n<p>Much interest in the Lemhi River and its tributaries has been around for some time. According to the Idaho Water Resource Board (IWRB), the &#8220;Lemhi River is one of the <a href=\"https:\/\/c.ymcdn.com\/sites\/idahocities.org\/resource\/resmgr\/trainings\/Water_Summit\/Idaho_Water_Conditions.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">cornerstones<\/a> of Idaho&#8217;s Salmon Recovery Effort.&#8221;<\/p>\n<p>In 2004, the Bureau of Reclamation (BOR) conducted a <a href=\"https:\/\/www.usbr.gov\/pn\/fcrps\/habitat\/projects\/uppersalmon\/reports\/lemhi\/instreamflow-june2004.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">study<\/a>, Instream Flow Assessment Big Timber Creek, Idaho, which covered stream flows and future needs for fish habitat protection. Idaho Fish &amp; Game (IDFG) conducted another <a href=\"https:\/\/collaboration.idfg.idaho.gov\/FisheriesTechnicalReports\/Mgt07-11Lamperth2006%20Fluvial%20Bull%20Tout%20Salvelinus%20Confluentus%20Migratory%20Dynamics-Life%20History%20in%20the%20Lemhi%20River%20Subbasin.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">study<\/a> in 2006, Bull Trout Migratory Dynamics and Life History in the Lemhi River Sub-Basin. This study determined Bull Trout &#8220;distribution has been restricted by water withdrawals from tributary streams.&#8221; End result, &#8220;Efforts are underway at this time to connect Big Timber Creek perennially to the Lemhi River. Once the project is completed, it is expected that a minimum discharge of 4.5 cfs will continually enter the Lemhi River throughout the year.&#8221; The stage is being set for relinquishing this water from private property to fish.<\/p>\n<p>In <a href=\"https:\/\/www.nwcouncil.org\/reports\/review-of-accord-proposal-upper-lemhi-river-%E2%80%93-acquisition-2008-601-00-%E2%80%93-response-request\" target=\"_blank\" rel=\"noopener noreferrer\">2008<\/a>, the Idaho Office of Species Conservation (OSC) put forth the Upper Lemhi River &#8211; Acquisition <a href=\"https:\/\/www.nwcouncil.org\/sites\/default\/files\/isrp2010_5.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">proposal<\/a>. Conservation easements and simple fee acquisitions were intended to &#8220;permanently protect in-stream and riparian habitat, improve river flow in the Lemhi River, and assist in reconnecting tributary streams to the Lemhi River to benefit all life stages of Snake River spring\/summer-run Chinook and Snake River steelhead&#8221;. Several ranches were involved in this proposal. Since that time there has been a growing, and concerted effort to take control over water, even water that flows over private property. The full proposal can be found <a href=\"https:\/\/www.nwcouncil.org\/sites\/default\/files\/200860100.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a> with IDFG, Idaho Department of Water Resources (IDWR), Bureau of Land Management (BLM), The Nature Conservancy (TNC), Upper Salmon Basin Watershed Program (USBWP), and Bonneville Power Administration (BPA) all being involved.<\/p>\n<p>BPA is <a href=\"https:\/\/www.bpa.gov\/news\/AboutUs\/Pages\/default.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">part<\/a> of the U.S. Department of Energy (DOE), sells electrical power to fund itself, and includes Idaho. Another BPA <a href=\"https:\/\/www.nfwf.org\/partnerships\/federal\/Pages\/home.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">partner<\/a> is the National Fish &amp; Wildlife Foundation (<a href=\"https:\/\/www.nfwf.org\/Pages\/default.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">NFWF<\/a>), which was <a href=\"https:\/\/www.nfwf.org\/whoweare\/Pages\/home.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">created<\/a> by Congress as a &#8221;\u00a0private\u00a0conservation grant-maker&#8221;. BPA also <a href=\"https:\/\/www.nfwf.org\/cbwtp\/Pages\/home.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">funds<\/a> the Columbia Basin Water Transaction Program (<a href=\"https:\/\/www.cbwtp.org\/the-program\/overview.html\" target=\"_blank\" rel=\"noopener noreferrer\">CBWT<\/a>), which was &#8220;developed in 2002 to address chronically diminished stream flows in tributaries of the Columbia River.&#8221;, and &#8220;works through locally based\u00a0entities to <u>acquire water rights<\/u>\u00a0voluntarily from willing\u00a0landowners&#8221;. In this program, BPA &#8220;works in cooperation with the Northwest Power and Conservation Council (<a href=\"https:\/\/www.nwcouncil.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">NPCC<\/a>) and with support from <a href=\"https:\/\/en.wikipedia.org\/wiki\/Altria\" target=\"_blank\" rel=\"noopener noreferrer\">Altria<\/a>.&#8221;, IDWR, and Trout Unlimited. NPCC <a href=\"https:\/\/www.nwcouncil.org\/about\" target=\"_blank\" rel=\"noopener noreferrer\">authorized<\/a> western states to &#8220;develop a regional power plan and fish and wildlife program&#8221;.<\/p>\n<p>IDWR has its own Water Transaction Program (<a href=\"https:\/\/idwr.idaho.gov\/files\/iwrb\/2010\/2010-IWTP-brochure.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">WTP<\/a>) specific to the Upper Salmon River Basin, for the purpose of &#8220;improving flows in streams and rivers&#8221;. Their partners include the BPA, NFWF, NPCC, and OSC. According to their brochure, Idaho is &#8220;determined&#8221; to reconnect tributaries to recover ESA-listed fish, with the Big Timber Creek being the highest priority, claiming that it is dewatered. With the Upper Salmon Basin Watershed Program (<a href=\"https:\/\/modelwatershed.idaho.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\">USRBWP)<\/a>, the <a href=\"https:\/\/idwr.idaho.gov\/IWRB\/\" target=\"_blank\" rel=\"noopener noreferrer\">IWRB<\/a> reviews projects to ensure that transactions are developed on high priority stream reaches, without naming the other partners. However, USRBWP has an extensive list of <a href=\"https:\/\/modelwatershed.idaho.gov\/partners\/\" target=\"_blank\" rel=\"noopener noreferrer\">partners<\/a> that includes federal and state governments, BPA, Tribes, land trusts, and non-governmental organizations (NGO).<\/p>\n<p>Another organization, Western States Water Council (<a href=\"https:\/\/www.westernstateswater.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">WSWC<\/a>), consisting of governor-appointed representatives in 18 western states, was <a href=\"https:\/\/www.westernstateswater.org\/about-wswc\/\" target=\"_blank\" rel=\"noopener noreferrer\">created<\/a> to facilitate cooperation in the conservation, development, and management of water resources. Its &#8220;<a href=\"https:\/\/secureservercdn.net\/198.71.233.51\/y6u.adc.myftpupload.com\/wp-content\/uploads\/2019\/01\/Vision-on-Water_2018Oct26.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Vision<\/a>&#8221; statement &#8220;transcends political and geographic boundaries&#8221; with all levels of government prioritizing &#8220;the collection, analysis and open sharing of reliable data regarding water availability&#8230;and usage&#8221;. In other words, jurisdictional boundaries are irrelevant. <a href=\"https:\/\/www.westernstateswater.org\/westfast\/\" target=\"_blank\" rel=\"noopener noreferrer\">WestFast<\/a> was created to collaborate with 12 Federal agencies that have water management responsibilities in the West, and <a href=\"https:\/\/secureservercdn.net\/198.71.233.51\/y6u.adc.myftpupload.com\/wp-content\/uploads\/2012\/10\/WestFAST_FactSheet1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">coordinate<\/a> Federal efforts regarding water resources. WSWC also <a href=\"https:\/\/www.westernstateswater.org\/wp-content\/uploads\/2012\/10\/397_SECURE-Water-Act_2016Sep30.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">supports<\/a> the S. 2156 Secure Water <a href=\"https:\/\/www.energy.senate.gov\/public\/index.cfm\/2007\/10\/bill-36ba9ffa-2adf-4cb9-8db9-366ea591a0de\" target=\"_blank\" rel=\"noopener noreferrer\">Act<\/a> which includes &#8220;basin-wide coordination that involves all governmental entities&#8221;, &#8220;grants or&#8230;cooperative agreements to assist states and other non-federal entities in carrying out a range of water use efficiency improvement&#8221;, and develop a &#8220;<u>national groundwater monitoring program<\/u>&#8230;and the <u>establishment of a national water availability and use assessment<\/u>&#8220;, along with other massive data-gathering schemes.<\/p>\n<p>However, data collection on water in the Lower and Upper Lemhi River Basin was already conducted for BOR, OSC, and IDWR in the 2006 Mike Basin <a href=\"https:\/\/idwr.idaho.gov\/files\/iwrb\/2006\/200609-MIKE-Basin-Model-Lemhi-River-Tributaries-Report.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Model<\/a>, an integrated water resource management and planning computer model that integrates a GIS with water resource modeling. The intent of using this model was for improving stream flows for fish. Both basins were analyzed with the intent to merge both for creating a comprehensive model of the entire Lemhi River Basin. &#8220;The United Nations FAO 56 <a href=\"https:\/\/www.ncl.ucar.edu\/Applications\/crop.shtml\" target=\"_blank\" rel=\"noopener noreferrer\">method<\/a> for evaluating crop evapotranspiration and computing crop water requirements has been recently incorporated into MIKE BASIN&#8221;&#8230;and&#8230;&#8221;could be incorporated into future upgrades of the LRMBM.&#8221; (pg. 76). Recommendations include the need for more data collection and analysis, but the model &#8220;resulted in the development of skeleton surface water budget model for the Lemhi River and 12 tributary basins&#8221;, as well as creating &#8220;a water rights inventory for diversions&#8221;. The Mike Basin Model is now known as the Mike Hydro <a href=\"https:\/\/www.mikepoweredbydhi.com\/products\/mike-hydro-basin\" target=\"_blank\" rel=\"noopener noreferrer\">Basin<\/a> and is &#8220;<strong><u>designed for <\/u><\/strong><em><strong><u>analyzing water sharing issues<\/u><\/strong><\/em><u> <strong>at international, national or local river basin scale<\/strong><\/u>.&#8221;<\/p>\n<p>The Western Watershed Project (<a href=\"https:\/\/www.westernwatersheds.org\/about\/\" target=\"_blank\" rel=\"noopener noreferrer\">WWP<\/a>) is another NGO whose mission is to &#8220;protect and restore western watersheds&#8221; with the Lemhi River <a href=\"https:\/\/www.westernwatersheds.org\/where_we_work\/idaho\/current-idaho-projects\/\" target=\"_blank\" rel=\"noopener noreferrer\">watershed<\/a> being one focus area. Partners include the Center for Biological Diversity (CBD) whose mission is to &#8220;save life on earth&#8221; and &#8220;is <a href=\"https:\/\/www.cbd.int\/convention\/\" target=\"_blank\" rel=\"noopener noreferrer\">dedicated<\/a> to promoting sustainable development. Conceived as a practical tool for translating the principles of Agenda 21 into reality&#8221;. CBD is a partner with Advocates for the <a href=\"https:\/\/advocateswest.org\/the-advocates\/partners\/\" target=\"_blank\" rel=\"noopener noreferrer\">West<\/a> that pays millions of dollars for litigation on the behalf of CBD and multiple other NGOs.<\/p>\n<p>As seen by all of this information, there are specific, very well-funded organizations, in partnership with state and federal agencies that are targeting water and private landowners who live in not only Lemhi county, but in the rest of Idaho. But others are involved in the pursuit of protecting fish, their habitat, and conserving water because of either the alleged current, or predicted future, water crisis, which is all <a href=\"https:\/\/conservation.idaho.gov\/Project\/Index\" target=\"_blank\" rel=\"noopener noreferrer\">tracked<\/a>.<\/p>\n<p>Conservation easements (CE) are part of this plan. In 2015, the Lemhi Regional Land Trust (LRLT), in <a href=\"https:\/\/www.bpa.gov\/news\/pubs\/FactSheets\/fs-201507-BPA-partners-with-Idaho-to-secure-more-than-4600-acres-to-benefit-fish.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">partnership<\/a> with the <a href=\"https:\/\/www.bpa.gov\/efw\/FishWildlife\/Land\/Announcements\/UpperLemhiRiverConservationEasement.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">BPA<\/a> and OSC, bought a 4,682 acre <a href=\"https:\/\/www.bpa.gov\/efw\/FishWildlife\/Land\/Announcements\/UpperLemhiRiverConservationEasement.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">CE<\/a> to &#8220;permanently protect nearly 10 miles of in-stream and riparian habitat&#8221; near Leadore. BPA provided the funding for this CE, with the LRLT holding the easement. This CE was also intended to &#8220;partially mitigate the impacts to salmon and steelhead from the construction, inundation and continued operation of federal hydroelectric dams&#8221; in which BPA participates. The objective was partly for improving <a href=\"https:\/\/www.thefreedictionary.com\/Salmonids\" target=\"_blank\" rel=\"noopener noreferrer\">salmonid<\/a> habitat. This land was part of Leadore Land <a href=\"http:\/\/www.lemhilandtrust.org\/tyler-ranch\/\" target=\"_blank\" rel=\"noopener noreferrer\">Partners<\/a>, a limited <a href=\"https:\/\/www.bizapedia.com\/mt\/leadore-land-partners-limited-partnership.html\" target=\"_blank\" rel=\"noopener noreferrer\">partnership<\/a> created in 2000 based in <a href=\"https:\/\/www.mapquest.com\/us\/montana\/leadore-land-partners-limited-partnershi-379258065\" target=\"_blank\" rel=\"noopener noreferrer\">Missoula<\/a>, Montana, and is owned by Karl &amp; Donna <a href=\"https:\/\/idrange.org\/range-stories\/central-idaho\/tyler-family-inks-conservation-easement-partnering-with-lemhi-land-trust-to-enhance-salmon-and-steelhead-habitat\/\" target=\"_blank\" rel=\"noopener noreferrer\">Tyler<\/a>. According to this <a href=\"https:\/\/www.cbfish.org\/Contract.mvc\/Summary\/BPA-008233\" target=\"_blank\" rel=\"noopener noreferrer\">document<\/a> the Tylers were paid $7,300,000, and $680,000 for &#8220;stewardship funding&#8221;. Idaho also <a href=\"https:\/\/www.deseret.com\/2015\/7\/30\/20484867\/salmon-habitat-protected-in-e-idaho-conservation-easement#this-june-26-2015-photo-shows-an-aerial-view-of-the-lemhi-river-and-big-springs-creek-as-they-merge-on-karl-tylers-ranch-near-leadore-idaho-the-bonneville-power-administration-recently-signed-a-conservation-easement-with-tyler-on-about-5000-acres-that-pro\" target=\"_blank\" rel=\"noopener noreferrer\">contributed<\/a> $3.5 million of your tax dollars towards this CE. A Riparian Habitat Management <a href=\"https:\/\/www.usbr.gov\/pn\/fcrps\/rme\/uppersalmon\/Cardno_FINAL_UpperLemhi_Riparian_Mgt_Plan_1-5-16_reduced.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Plan<\/a> for this area was finalized in 2016. As noted by NPCC, this CE was just one of several being <a href=\"https:\/\/www.nwcouncil.org\/sites\/default\/files\/200860100.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">pursued<\/a> on four ranches beginning in 2008.<\/p>\n<p>Pursuit of conservation easements will ultimately assist in achieving the goal of controlling water in Lemhi county, with your tax dollar providing monetary benefits to landowners who participate in signing over their land.
