Rep. <a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2024\/legislation\/SCR114SOP.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Tanner<\/a>, and <a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2024\/legislation\/SCR114LegCo.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">others<\/a>, supported a resolution for term <a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2024\/legislation\/SCR114SOP.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">limits<\/a>, Sen. Ricks and Vander Woude supported a balanced budget <a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2024\/legislation\/SCR115SOP.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">resolution<\/a>, while Sen. Lakey, and <a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2024\/legislation\/SCR115SOP.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">others<\/a>, supported a balanced <a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2024\/legislation\/SCR112SOP.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">budget<\/a>&nbsp;and term limit resolution. A series of articles were written on COS in 2024 with a historical <a href=\"https:\/\/gemstatepatriot.com\/blog\/article-v-convention-yes-or-no\/\" target=\"_blank\" rel=\"noreferrer noopener\">review<\/a> of Article V, COS&nbsp;<a href=\"https:\/\/gemstatepatriot.com\/blog\/convention-of-states-action-shenanigans\/\" target=\"_blank\" rel=\"noreferrer noopener\">background<\/a> work in Idaho and political <a href=\"https:\/\/gemstatepatriot.com\/blog\/deeper-dive-into-convention-of-states-action\/\" target=\"_blank\" rel=\"noreferrer noopener\">interference<\/a>, and individuals behind the <a href=\"https:\/\/gemstatepatriot.com\/blog\/the-heart-of-convention-of-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">organization<\/a>. All 2024 legislative&nbsp;<a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2024\/legislation\/SCR114\/\" target=\"_blank\" rel=\"noreferrer noopener\">resolutions<\/a> <a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2024\/legislation\/SCR114\/\" target=\"_blank\" rel=\"noreferrer noopener\">failed<\/a> to move <a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2025\/legislation\/HCR010\/\" target=\"_blank\" rel=\"noreferrer noopener\">forward<\/a>.&nbsp;<\/p>\n\n\n\n<p><strong>Supporters<\/strong><\/p>\n\n\n\n<p>In 2025, COS indirectly <a href=\"https:\/\/conventionofstates.com\/news\/idaho-decides-now-is-not-the-time-to-act\" target=\"_blank\" rel=\"noreferrer noopener\">shamed<\/a> Idaho for \u201cchoosing to stay on the sidelines\u201d and not continue its quest for a Convention. But COS is now back at it.<\/p>\n\n\n\n<p>In this 2026 legislative session, Rep. <a href=\"https:\/\/thefreedomindex.org\/id\/legislator\/23941\/\" target=\"_blank\" rel=\"noreferrer noopener\">Tanner<\/a>, Sen. <a href=\"https:\/\/thefreedomindex.org\/id\/legislator\/21016\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ricks<\/a>, Rep. Vander <a href=\"https:\/\/thefreedomindex.org\/id\/legislator\/12749\/\" target=\"_blank\" rel=\"noreferrer noopener\">Woude<\/a>, and Rep. <a href=\"https:\/\/thefreedomindex.org\/id\/legislator\/25761\/\" target=\"_blank\" rel=\"noreferrer noopener\">Shirts<\/a> have introduced HCR <a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2026\/legislation\/HCR025\/\" target=\"_blank\" rel=\"noreferrer noopener\">25<\/a>&nbsp;for a balanced budget amendment which was referred to the House State Affairs <a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2026\/standingcommittees\/HSTA\/\" target=\"_blank\" rel=\"noreferrer noopener\">committee<\/a>. Rep. Shirts introduced HCR <a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2026\/legislation\/HCR023\/\" target=\"_blank\" rel=\"noreferrer noopener\">23<\/a>&nbsp;for the term limit amendment and it has been referred to the House Judiciary, Rules&nbsp;&amp;&nbsp;Administration <a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2026\/standingcommittees\/HJUD\/\" target=\"_blank\" rel=\"noreferrer noopener\">committee<\/a>.<\/p>\n\n\n\n<p>There is a group of national COS supporters including Mark <a href=\"https:\/\/conventionofstates.com\/news\/listen-mark-levin-and-mark-meckler-celebrate-kansas-victory-on-the-air\" target=\"_blank\" rel=\"noreferrer noopener\">Levin<\/a>, Rick <a href=\"https:\/\/conventionofstates.com\/news\/rick-santorum-on-september-3-edition-of-cos-at-home\" target=\"_blank\" rel=\"noreferrer noopener\">Santorum<\/a>&nbsp;(who <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/472245708\/202543149349303344\/full\" target=\"_blank\" rel=\"noreferrer noopener\">received<\/a> $335,483 in 2024),&nbsp;Ted <a href=\"https:\/\/conventionofstates.com\/videos\/ted-cruz-momentum-for-convention-of-states-is-growing\" target=\"_blank\" rel=\"noreferrer noopener\">Cruz<\/a>, and Marco <a href=\"https:\/\/conventionofstates.com\/news\/special-announcement-senator-marco-rubio-endorses-the-convention-of-states-project\" target=\"_blank\" rel=\"noreferrer noopener\">Rubio<\/a>. The list of those currently <a href=\"https:\/\/conventionofstatesfoundation.org\/endorsements\/\" target=\"_blank\" rel=\"noreferrer noopener\">endorsing<\/a> COS includes current government officials who could fix the budget and term limit issues now, while in office, instead of going through a time consuming and potentially dangerous process for a convention to fix the problems. What&#8217;s up with that?&nbsp;<\/p>\n\n\n\n<p>Even crazier, Speaker of the House, Mike <a href=\"https:\/\/www.speaker.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">Johnson<\/a>, is <a href=\"https:\/\/conventionofstates.com\/dear-legislator\" target=\"_blank\" rel=\"noreferrer noopener\">on<\/a> the list of <a href=\"https:\/\/conventionofstates.com\/news\/who-is-speaker-mike-johnson\" target=\"_blank\" rel=\"noreferrer noopener\">supporters<\/a>! Why doesn&#8217;t he use his current role to facilitate balanced budget and term limit legislation or <a href=\"https:\/\/www.archives.gov\/federal-register\/constitution\" target=\"_blank\" rel=\"noreferrer noopener\">amendments<\/a>? Why doesn\u2019t Sen. Paul and Sen. Cruz get together and get the job done? Maybe because amendments on those issues really aren&#8217;t wanted. Florida Gov. Ron <a href=\"https:\/\/conventionofstates.com\/news\/florida-governor-endorses-convention-of-states\">DeSantis<\/a> has even been in <a href=\"https:\/\/www.kivitv.com\/downtown-boise\/watch-live-florida-gov-ron-desantis-visits-idaho-to-push-balanced-budget-amendment\">Idaho<\/a> <a href=\"https:\/\/floridapolitics.com\/archives\/774086-balanced-budget-desantis-idaho\/\">supporting<\/a> COS.<\/p>\n\n\n\n<p>Rep. <a href=\"https:\/\/conventionofstates.com\/news\/a-disappointing-setback-in-the-gem-state\" target=\"_blank\" rel=\"noreferrer noopener\">Tanner<\/a>&nbsp;continues as an advocate for Constitutional amendments. Rep. Joe <a href=\"https:\/\/thefreedomindex.org\/id\/legislator\/23915\/\" target=\"_blank\" rel=\"noreferrer noopener\">Alfieri<\/a> had an interesting <a href=\"https:\/\/conventionofstates.com\/news\/a-disappointing-setback-in-the-gem-state\" target=\"_blank\" rel=\"noreferrer noopener\">comment<\/a> on COS,&nbsp;\u201dWe have a process problem\u2014the process problem that exists is the way that the federal government is functioning,\u201d&#8230;\u201dIt\u2019s the states\u2019 right to define what the federal government does. We have to take that right back.\u201d<\/p>\n\n\n\n<p>With all due respect to Rep. Alfieri, it is the federal government not following the Constitution that is the problem, and it is not state <a href=\"https:\/\/uslawexplained.com\/state_s_rights\" target=\"_blank\" rel=\"noreferrer noopener\">rights<\/a> that define what the federal government does which has been <a href=\"https:\/\/www.ebsco.com\/research-starters\/law\/states-rights-and-state-sovereignty\" target=\"_blank\" rel=\"noreferrer noopener\">challenged<\/a> many times in court. What the federal government does, or at least supposed to do, is outlined in the U.S. Constitution with defined enumerated <a href=\"https:\/\/constitution.congress.gov\/browse\/article-1\/section-8\/\" target=\"_blank\" rel=\"noreferrer noopener\">powers<\/a>, and to pay its <a href=\"https:\/\/billofrightsinstitute.org\/activities\/handout-c-article-i-section-8-of-the-u-s-constitution?gad_source=1\" target=\"_blank\" rel=\"noreferrer noopener\">debts<\/a>. As for a balanced budget, Idaho doesn&#8217;t seem to have any problem <a href=\"https:\/\/usafacts.org\/answers\/how-much-money-does-the-federal-government-provide-state-and-local-governments\/state\/idaho\/\" target=\"_blank\" rel=\"noreferrer noopener\">taking<\/a> federal money even though that money contributes to a deficit ridden federal budget. Maybe Idaho should exercise its state right to decline that federal money.<\/p>\n\n\n\n<p>This historical perspective <a href=\"https:\/\/constitutioncenter.org\/blog\/the-constitution-and-the-federal-budget-process\" target=\"_blank\" rel=\"noreferrer noopener\">discusses<\/a> how the federal budgetary process has been warped over the years. Congress has just added laws to justify its maleficence. There are also <a href=\"https:\/\/www.investopedia.com\/ask\/answers\/042415\/what-are-pros-and-cons-operating-balancedbudget.asp\" target=\"_blank\" rel=\"noreferrer noopener\">some<\/a> who <a href=\"https:\/\/www.cbpp.org\/research\/federal-budget\/a-balanced-budget-amendment-doesnt-change-the-math\" target=\"_blank\" rel=\"noreferrer noopener\">describe<\/a> how a balanced <a href=\"https:\/\/taxpolicycenter.org\/briefing-book\/state-and-local-tax\/fiscal-federalism-and\/what-are-state-balanced\" target=\"_blank\" rel=\"noreferrer noopener\">budget<\/a> amendment would not <a href=\"https:\/\/www.cbpp.org\/research\/federal-budget\/constitutional-balanced-budget-amendment-poses-serious-risks\" target=\"_blank\" rel=\"noreferrer noopener\">work<\/a>, mostly due to the feckless nature of Congress. An amendment doesn&#8217;t fix bad behavior.<\/p>\n\n\n\n<p>Back to COS, the below PDF lists Idaho elected officials who received money from the COS Action political <a href=\"https:\/\/sunshine.voteidaho.gov\/public\/cf\/candidateprofile?guid=f2cca1c4-2237-4126-aa0b-4884a898b884&amp;tabName=COM&amp;isLegacy=false\" target=\"_blank\" rel=\"noreferrer noopener\">committee<\/a> in 2024, including some who are again supporting COS. The COS <a href=\"https:\/\/conventionofstates.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Action<\/a> 2024 Form <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/472245708\/202543149349303344\/full\" target=\"_blank\" rel=\"noreferrer noopener\">990<\/a>&nbsp;also lists these candidates, and a few others, in supporting its mission. The COS political committee was terminated in 2024.<\/p>\n\n\n\n<div data-wp-interactive=\"core\/file\" class=\"wp-block-file\"><object data-wp-bind--hidden=\"!state.hasPdfPreview\" hidden class=\"wp-block-file__embed\" data=\"https:\/\/gemstatepatriot.com\/blog\/wp-content\/uploads\/2026\/02\/money.pdf\" type=\"application\/pdf\" style=\"width:100%;height:600px\" aria-label=\"Embed of COS Action PAC donations.\"><\/object><a id=\"wp-block-file--media-03758cfe-b3ab-47bd-9c8c-cada39f02ea1\" href=\"https:\/\/gemstatepatriot.com\/blog\/wp-content\/uploads\/2026\/02\/money.pdf\">COS Action PAC donations<\/a><a href=\"https:\/\/gemstatepatriot.com\/blog\/wp-content\/uploads\/2026\/02\/money.pdf\" class=\"wp-block-file__button wp-element-button\" download aria-describedby=\"wp-block-file--media-03758cfe-b3ab-47bd-9c8c-cada39f02ea1\">Download<\/a><\/div>\n\n\n\n<p><strong>Current Status<\/strong><\/p>\n\n\n\n<p>Billionaire <a href=\"https:\/\/grokipedia.com\/page\/Tim_Dunn_(businessman)\" target=\"_blank\" rel=\"noreferrer noopener\">Tim<\/a> <a href=\"https:\/\/gemstatepatriot.com\/blog\/the-heart-of-convention-of-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">Dunn<\/a>, the deep <a href=\"https:\/\/gemstatepatriot.com\/blog\/the-heart-of-convention-of-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">pocket<\/a> behind COS, is still the Director of his non-profit, America First Policy <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/854202763\/202533079349303153\/full\" target=\"_blank\" rel=\"noreferrer noopener\">Institute<\/a>, which holds over $25 million dollars in assets, and is a COS <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/472245708\/202323119349300022\/full\" target=\"_blank\" rel=\"noreferrer noopener\">Action<\/a> Director monetarily influencing Idaho politics. Dunn is still causing political&nbsp;<a href=\"https:\/\/www.propublica.org\/article\/tim-dunn-farris-wilks-texas-christian-nationalism-dominionism-elections-voting\" target=\"_blank\" rel=\"noreferrer noopener\">headaches<\/a> in Texas with his billions. The Institute <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/854202763\/202533079349303153\/full\" target=\"_blank\" rel=\"noreferrer noopener\">contributes<\/a> to the Immigration Reform Law <a href=\"https:\/\/www.irli.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Institute<\/a>, America First Policy Institute-<a href=\"https:\/\/www.americafirstpolicy.com\/state-chapter\/america-first-pennsylvania\" target=\"_blank\" rel=\"noreferrer noopener\">Pennsylvania<\/a>, Constitutional <a href=\"https:\/\/www.constitutionalcoalition.org\/about\" target=\"_blank\" rel=\"noreferrer noopener\">Coalition<\/a>, and&nbsp;Susan B. Anthony <a href=\"https:\/\/en.wikipedia.org\/wiki\/Susan_B._Anthony_Pro-Life_America\" target=\"_blank\" rel=\"noreferrer noopener\">List <\/a>Inc.. These are all worthy causes that self-described conservatives would probably support. If the original Constitution was followed, perhaps none of these groups would even need to exist.<\/p>\n\n\n\n<p>While North Dakota <a href=\"https:\/\/conventionofstates.com\/news\/north-dakota-is-number-10-legislature-passes-convention-of-states-resolution\" target=\"_blank\" rel=\"noreferrer noopener\">joined<\/a> COS in 2017, an effort was made in <a href=\"https:\/\/conventionofstates.com\/news\/fighting-back-north-dakota-recission-effort\" target=\"_blank\" rel=\"noreferrer noopener\">2021<\/a> to rescind its resolution, and <a href=\"https:\/\/ndlegis.gov\/assembly\/69-2025\/regular\/bill-overview\/bo4003.html\" target=\"_blank\" rel=\"noreferrer noopener\">again<\/a> in <a href=\"https:\/\/ndlegis.gov\/files\/resource\/69-2025\/library\/scr4003.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">2025<\/a>. COS <a href=\"https:\/\/conventionofstates.com\/files\/mark-meckler-convention-of-states\" target=\"_blank\" rel=\"noreferrer noopener\">President<\/a>, Mark <a href=\"https:\/\/www.foiaresearch.net\/person\/mark-meckler\" target=\"_blank\" rel=\"noreferrer noopener\">Meckler<\/a>, provided an interesting <a href=\"https:\/\/ndlegis.gov\/assembly\/69-2025\/testimony\/SJUD-4003-20250122-30179-A-MECKLER_MARK.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">speech<\/a>&nbsp;to the North Dakota legislature opposing the 2025 rescission. One of his more interesting comments is on page 2, \u201c&#8230;this plan of relying on Congress to do what the nation needs is not working. More importantly, it has never worked. When was the last time a government voluntarily limited its own authority?\u201d The way he states it almost insinuates the Constitution has never worked. Indeed, Congress has passed <a href=\"https:\/\/constitutionus.com\/constitution\/amendments\/constitutional-amendments\/\" target=\"_blank\" rel=\"noreferrer noopener\">27<\/a> amendments, several of which have limited its power. Perhaps it is not working because the Constitution itself is not being followed.&nbsp;<\/p>\n\n\n\n<p>Another interesting comment he made on page <a href=\"https:\/\/ndlegis.gov\/assembly\/69-2025\/testimony\/SJUD-4003-20250122-30179-A-MECKLER_MARK.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">3<\/a> after attacking national \u201cleft-wing\u201d groups for opposing a Convention of States, \u201c&#8230;they are afraid that it would remove their power in DC, and return it to you, the state legislatures.\u201d Is he suggesting a Convention of States would give power to state legislatures rather than placing constraints on the federal budget and forcing term limits? He then called for the North Dakota legislature to \u201c&#8230;use the constitutional authority the Founders gave you to intervene on behalf of the people and stop federal overreach.\u201d Neither balanced budget or term limit amendments really address federal <a href=\"https:\/\/legalclarity.org\/federal-overreach-definition-and-constitutional-limits\/\" target=\"_blank\" rel=\"noreferrer noopener\">overreach<\/a>. The effort to rescind COS in North Dakota failed.<\/p>\n\n\n\n<p>Historically, a provision to address federal overreach was already <a href=\"https:\/\/legalclarity.org\/can-states-legally-nullify-federal-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">provided<\/a> by Marbury v. Madison, that \u201c&#8230;a law repugnant to the Constitution is void, and that courts, as well as other departments, are bound by that instrument.\u201d \u201cThe Court <a href=\"https:\/\/legalclarity.org\/can-states-legally-nullify-federal-laws\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that because the Constitution is the paramount law, any legislative act contrary to it is not law and is void.\u201d States just need to exercise it more often as defined in the Tenth <a href=\"https:\/\/www.law.cornell.edu\/constitution\/tenth_amendment\" target=\"_blank\" rel=\"noreferrer noopener\">Amendment<\/a>. As noted by&nbsp;Joe A. <a href=\"https:\/\/thenewamerican.com\/author\/joe-wolverton-ii-j-d\/?utm_source=_pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Wolverton<\/a>, II, J.D.,&nbsp;\u201dNext, it is a well-known <a href=\"https:\/\/thenewamerican.com\/us\/politics\/constitution\/mark-meckler-convention-of-states-could-take-10-25-years-to-accomplish\/_pdf\/\" target=\"_blank\" rel=\"noreferrer noopener\">fact<\/a> that the COS organization opposes any effort by states to refuse to enact unconstitutional programs or policies of the federal government.\u201d That would be truly be exercising state rights.<\/p>\n\n\n\n<p>The House State Affairs committee passed HCR 25 on February <a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2026\/standingcommittees\/260203_hsta_0900AM-Agenda.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">3<\/a>&nbsp;and filed for a third <a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2026\/legislation\/HCR025\/\" target=\"_blank\" rel=\"noreferrer noopener\">reading<\/a> on February 4. The download video of the February 3 meeting is <a href=\"https:\/\/legislature.idaho.gov\/sessioninfo\/2026\/standingcommittees\/HSTA\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>. In his testimony, Rep. Shirts now states the intention is not to call a convention but rather to \u201cthreaten\u201d Congress with calling a convention, even though the resolution specifically calls for one. He also discussed a template amendment with a ten-year debt break, basically outlining how Congress should get out of debt. That seems to already go beyond just the balanced budget amendment.<\/p>\n\n\n\n<p><strong>Historical Misrepresentation<\/strong><\/p>\n\n\n\n<p>In another speech to the Kansas Senate Committee in 2018, Meckler&nbsp;<a href=\"https:\/\/kslegislature.gov\/li_2018\/b2017_18\/committees\/ctte_s_fed_st_1\/documents\/testimony\/20180214_05.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">insisted<\/a>&nbsp;\u201dGeorge Mason specifically predicted that the federal government would one day overpower the states. And that is why he insisted that Article V include a way for states to propose constitutional amendments through a state-controlled convention.\u201d<\/p>\n\n\n\n<p>In truth, while Mason did express concerns, it was actually Gouverneur <a href=\"https:\/\/en.wikipedia.org\/wiki\/Gouverneur_Morris#Public_office_and_Constitutional_Convention\" target=\"_blank\" rel=\"noreferrer noopener\">Morris<\/a> and Elbridge <a href=\"https:\/\/www.archives.gov\/publications\/prologue\/2006\/spring\/gerry.html\">Gerry<\/a> (of gerrymandering <a href=\"https:\/\/constitutioncenter.org\/signers\/elbridge-gerry\">fame<\/a>) who \u201c<a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artV-2\/ALDE_00013047\/\" target=\"_blank\" rel=\"noreferrer noopener\">proposed<\/a> to <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artV-2\/ALDE_00013047\/#essay-25\" target=\"_blank\" rel=\"noreferrer noopener\">remedy<\/a> this perceived problem by requiring Congress to call a convention of the states for proposing amendments upon the application of two-thirds of the states&#8230;\u201d, and then \u201c<a href=\"https:\/\/www.law.cornell.edu\/constitution-conan\/article-5\/article-v-historical-background\" target=\"_blank\" rel=\"noreferrer noopener\">succeeded<\/a> in inserting the language providing for a convention upon the application of the legislatures of two-thirds of the states.\u201d James <a href=\"https:\/\/www.law.cornell.edu\/constitution-conan\/article-5\/debates-in-the-federal-convention\" target=\"_blank\" rel=\"noreferrer noopener\">Wilson<\/a> was the delegate who&nbsp;<a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artV-2\/ALDE_00013047\/#essay-25\" target=\"_blank\" rel=\"noreferrer noopener\">moved<\/a> \u201cto require three-fourths of the states for ratification of an amendment.\u201d In truth, several <a href=\"https:\/\/www.nps.gov\/articles\/000\/constitutionalconvention-september10.htm\" target=\"_blank\" rel=\"noreferrer noopener\">delegates<\/a>&nbsp;debated the state convention and ratification issue.<\/p>\n\n\n\n<p>This change to Article V came from the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Gouverneur_Morris#Public_office_and_Constitutional_Convention\" target=\"_blank\" rel=\"noreferrer noopener\">Committee<\/a> on <a href=\"https:\/\/constitutioncenter.org\/american-treasures\/committee-of-style-report\/kiosk\" target=\"_blank\" rel=\"noreferrer noopener\">Style<\/a> and <a href=\"https:\/\/www.usconstitution.net\/draft_sep12-html\/\" target=\"_blank\" rel=\"noreferrer noopener\">Arrangement<\/a> that <a href=\"https:\/\/prologue.blogs.archives.gov\/2022\/09\/12\/drafting-the-u-s-constitution\/\">included<\/a> Alexander Hamilton, William Johnson, Rufus King, James Madison, and Gouverneur Morris. The Committee didn&#8217;t&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Gouverneur_Morris#Public_office_and_Constitutional_Convention\" target=\"_blank\" rel=\"noreferrer noopener\">draft<\/a> the final language of the proposed constitution&nbsp;(pg <a href=\"https:\/\/archive.org\/details\/us_farrand\/llfr002\/page\/602\/mode\/2up\" target=\"_blank\" rel=\"noreferrer noopener\">206<\/a>) \u201cuntil a <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artV-2\/ALDE_00013047\/#essay-25\" target=\"_blank\" rel=\"noreferrer noopener\">month<\/a> before the end of the Federal Convention.\u201d Mason wasn&#8217;t even on the committee, however,&nbsp;\u201dMadison\u2019s twelve <a href=\"https:\/\/billofrightsinstitute.org\/activities\/handout-a-george-mason-1725-1792\" target=\"_blank\" rel=\"noreferrer noopener\">amendments<\/a> were based on Mason\u2019s ideas.\u201d In the end, <a href=\"https:\/\/www.archives.gov\/files\/legislative\/resources\/education\/bill-of-rights\/images\/mason.pdf\">Mason<\/a> <a href=\"https:\/\/billofrightsinstitute.org\/activities\/handout-a-george-mason-1725-1792\" target=\"_blank\" rel=\"noreferrer noopener\">refused<\/a> to sign the Constitution but is remembered for his <a href=\"https:\/\/www.usconstitution.net\/george-masons-impact-on-bill-of-rights\/\">contribution<\/a> to the Bill of Rights.<\/p>\n\n\n\n<p>The point is, Mr. Meckler has a <a href=\"https:\/\/gemstatepatriot.com\/blog\/article-v-convention-yes-or-no\/\" target=\"_blank\" rel=\"noreferrer noopener\">history<\/a> of distorting history. His <a href=\"https:\/\/kslegislature.gov\/li_2018\/b2017_18\/committees\/ctte_s_fed_st_1\/documents\/testimony\/20180214_05.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> that \u201cMason\u2019s proposal was adopted without dissent\u201d is a distortion of what actually happened.&nbsp;<\/p>\n\n\n\n<p><strong>Areas of<\/strong> <strong>Concern<\/strong><\/p>\n\n\n\n<p>Perhaps it is the \u201cCongress and Convention <a href=\"https:\/\/legalclarity.org\/how-many-states-have-called-for-a-constitutional-convention\/\" target=\"_blank\" rel=\"noreferrer noopener\">Procedures<\/a>\u201c that legitimize the massive concern over how a convention would be conducted. Issues not <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artV-3-3\/ALDE_00013051\/\" target=\"_blank\" rel=\"noreferrer noopener\">defined<\/a> include how delegates are chosen, the number of votes per state, voting thresholds, and if Congress can refuse to send proposed amendments to the states. Since there is no procedure, it might just be possible Congress could <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artV-3-3\/ALDE_00013051\/\" target=\"_blank\" rel=\"noreferrer noopener\">refuse<\/a> to send proposed amendments to the states for ratification. Given current COS supporters in Congress won&#8217;t address the two issues, refusing to send proposed amendments to states might just be possible. Additionally, \u201cThere is also no clear legal <a href=\"https:\/\/legalclarity.org\/how-many-states-have-called-for-a-constitutional-convention\/\" target=\"_blank\" rel=\"noreferrer noopener\">precedent<\/a> on whether a court could or would force Congress to act if it refused to call a convention.\u201d&nbsp;<\/p>\n\n\n\n<p>Even Madison expressed concerns about adding Article V, \u201cThis apprehension follows from the context of how the convention only to amend the Articles of Confederation became a convention for the writing of an entirely new Constitution in its place (pg <a href=\"https:\/\/scholarship.law.wm.edu\/cgi\/viewcontent.cgi?article=2118&amp;context=wmborj\" target=\"_blank\" rel=\"noreferrer noopener\">916<\/a>).\u201d That&#8217;s right, what was supposed to be a couple of amendments turned into a whole scrapping of one document and <a href=\"https:\/\/gemstatepatriot.com\/blog\/article-v-convention-yes-or-no\/\" target=\"_blank\" rel=\"noreferrer noopener\">creation<\/a> of a new one, and Madison understood it could happen again.<\/p>\n\n\n\n<p>However, Meckler already has it all figured out with a \u201cpre-convention planning\u201d <a href=\"https:\/\/grokipedia.com\/page\/Mark_Meckler\" target=\"_blank\" rel=\"noreferrer noopener\">strategy<\/a>, where, apparently, his organization will decide what is lacking in Article V. Part of his strategy is seen now, \u201crequiring resolutions\u201d, \u201cwith each resolution explicitly limited to the three reform categories\u201d. Idaho representatives are already falling for Meckler\u2019s plan by creating resolutions with limited categories, term limits and balanced budget.&nbsp;<\/p>\n\n\n\n<p>Other COS strategies include a plan for state delegate selection, voting rules, appointing delegates bound to resolution limits, proxy voting, and recalls for non-compliance. For someone who so stringently clings to the ideals of state rights, Meckler has chosen to create this model without a state&#8217;s right to debate how it would enact Article V with constituent input, and passing a statute that enshrines it. At least that is the way it is supposed to work, not just following the rulings from someone outside of the state.<\/p>\n\n\n\n<p>COS does <a href=\"https:\/\/conventionofstates.com\/news\/what-s-our-strategy\" target=\"_blank\" rel=\"noreferrer noopener\">discuss<\/a> two types of conventions but its link to its strategy comes up as a <a href=\"https:\/\/conventionofstates.com\/404\" target=\"_blank\" rel=\"noreferrer noopener\">404<\/a>. Another COS strategy is just waiting around for a new <a href=\"https:\/\/www.thedakotascout.com\/p\/south-dakotas-new-senate-class-friendlier\">group<\/a> of legislators.&nbsp;<\/p>\n\n\n\n<p>Again in truth, out of over 11,000 proposed <a href=\"https:\/\/archivesfoundation.org\/amendments-u-s-constitution\/\" target=\"_blank\" rel=\"noreferrer noopener\">amendments<\/a>, including <a href=\"https:\/\/www.archives.gov\/open\/dataset-amendments\" target=\"_blank\" rel=\"noreferrer noopener\">proposed<\/a> amendments for a balanced <a href=\"https:\/\/www.congress.gov\/crs-product\/R41907\" target=\"_blank\" rel=\"noreferrer noopener\">budget<\/a> and term <a href=\"https:\/\/www.congress.gov\/crs-product\/IF12343\" target=\"_blank\" rel=\"noreferrer noopener\">limits<\/a>, 27 Constitutional <a href=\"https:\/\/constitutionus.com\/constitution\/amendments\/constitutional-amendments\/\" target=\"_blank\" rel=\"noreferrer noopener\">amendments<\/a>&nbsp;have passed, all initiated by Congress. Six amendments have not been ratified by the states (<a href=\"https:\/\/www.congress.gov\/crs-product\/R47959\" target=\"_blank\" rel=\"noreferrer noopener\">Table 1<\/a>). COS needs 34 states to initiate an amendment, <a href=\"https:\/\/www.archives.gov\/federal-register\/constitution\" target=\"_blank\" rel=\"noreferrer noopener\">38<\/a> states are needed to&nbsp;<a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artV-4-1\/ALDE_00013053\/\" target=\"_blank\" rel=\"noreferrer noopener\">ratify<\/a> an amendment. Right now, states that have joined COS stands at <a href=\"https:\/\/conventionofstates.com\/states-that-have-passed-the-convention-of-states-article-v-application\" target=\"_blank\" rel=\"noreferrer noopener\">20<\/a>&nbsp;with <a href=\"https:\/\/legalclarity.org\/how-many-states-have-called-for-a-constitutional-convention\/\" target=\"_blank\" rel=\"noreferrer noopener\">14<\/a> states still needed.<\/p>\n\n\n\n<p><strong>The Plot Thickens<\/strong><\/p>\n\n\n\n<p>David M. Walker&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/David_M._Walker_(U.S._Comptroller_General)\" target=\"_blank\" rel=\"noreferrer noopener\">served<\/a> as the United States comptroller&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Comptroller_General_of_the_United_States\">general<\/a> from 1998 to 2008 and founded the now defunct Comeback America Initiative (<a href=\"https:\/\/keepingamericagreat.org\/about-cai\/\" target=\"_blank\" rel=\"noreferrer noopener\">CAI<\/a>). He and COS <a href=\"https:\/\/conventionofstatesfoundation.org\/endorsements\/\" target=\"_blank\" rel=\"noreferrer noopener\">supporter<\/a> Ken&nbsp;<a href=\"https:\/\/nhjournal.com\/author\/ken-cuccinelli\/\">Cuccinelli<\/a>, have <a href=\"https:\/\/nhjournal.com\/cuccinelli-walker-states-need-to-assert-their-rights-under-article-v-of-the-constitution\/\" target=\"_blank\" rel=\"noreferrer noopener\">joined<\/a> together to <a href=\"https:\/\/nfcommission.gov\/2024\/06\/three-article-v-convention-efforts-an-op-ed\/\" target=\"_blank\" rel=\"noreferrer noopener\">promote<\/a> a convention.<\/p>\n\n\n\n<p>In this <a href=\"https:\/\/pbswisconsin.org\/news-item\/how-a-proposed-lawsuit-would-seek-to-require-congress-to-convene-an-article-v-constitutional-convention\/\" target=\"_blank\" rel=\"noreferrer noopener\">article<\/a>, it is mentioned that the Federal Fiscal Sustainability Foundation, in which Walker is the <a href=\"https:\/\/ffsf.us\/team\/\" target=\"_blank\" rel=\"noreferrer noopener\">Chair<\/a>, and Cuccinelli a Director, have drafted a lawsuit against Congress charging that all resolutions for a convention since the late 1700&#8217;s to 1979 should be combined as they meet the threshold of 34, regardless of resolutions&#8217; topics, and regardless of states having rescinded their resolutions, they would still count. Called an Aggregation <a href=\"https:\/\/en.wikipedia.org\/wiki\/Convention_to_propose_amendments_to_the_United_States_Constitution\" target=\"_blank\" rel=\"noreferrer noopener\">strategy<\/a>, it involves counting all applications for a convention to reach the needed threshold. Congress even proposed <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/8419\" target=\"_blank\" rel=\"noreferrer noopener\">legislation<\/a>&nbsp;in 2022 that would aggregate resolutions! According to the article, this draft lawsuit has been shown to Attorneys General and legislators in several states. There is no link to the actual draft lawsuit in the article, nonetheless other <a href=\"https:\/\/www.msn.com\/en-nz\/news\/other\/absurd-pro-trump-effort-to-force-congress-to-hold-constitutional-convention-blasted\/ar-AA1B5IKZ\" target=\"_blank\" rel=\"noreferrer noopener\">media<\/a> sites have reported on it.&nbsp;<\/p>\n\n\n\n<p>However, the&nbsp;American Legislative Exchange Council (<a href=\"https:\/\/alec.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">ALEC<\/a>), a&nbsp;<a href=\"https:\/\/alec.org\/article\/a-convention-of-states-explained\/\" target=\"_blank\" rel=\"noreferrer noopener\">convention<\/a>&nbsp;<a href=\"https:\/\/alec.org\/tag\/convention-of-the-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">supporter<\/a>, posted a&nbsp;<a href=\"https:\/\/alec.org\/article\/four-paths-to-a-state-drafted-voter-ratified-u-s-balance-budget-amendment-bba\/\" target=\"_blank\" rel=\"noreferrer noopener\">video<\/a>&nbsp;in 2020 with&nbsp;Former Governor Scott Walker and others who&nbsp;suggested using aggregation and filing a lawsuit against Congress. David <a href=\"https:\/\/alec.org\/person\/david-biddulph\/\" target=\"_blank\" rel=\"noreferrer noopener\">Biddulph<\/a>&nbsp;stated&nbsp;records of applications are \u201cscattered\u201d without formal storage, however, application information is held by Congressional <a href=\"https:\/\/www.congress.gov\/search?q=%7B%22source%22%3A%22congrecord%22%2C%22congress%22%3A%5B43%2C44%2C45%2C46%2C47%2C48%2C49%2C50%2C51%2C52%2C53%2C54%2C55%2C56%2C57%2C58%2C59%2C60%2C61%2C62%2C63%2C64%2C65%2C66%2C67%2C68%2C69%2C70%2C71%2C72%2C73%2C74%2C75%2C76%2C77%2C78%2C79%2C80%2C81%2C82%2C83%2C84%2C85%2C86%2C87%2C88%2C89%2C90%2C91%2C92%2C93%2C94%2C95%2C96%2C97%2C98%2C99%2C100%2C101%2C102%2C103%5D%2C%22search%22%3A%22convention+of+states%22%7D\" target=\"_blank\" rel=\"noreferrer noopener\">Records<\/a>, albeit without formal storage, and <a href=\"https:\/\/en.wikipedia.org\/wiki\/List_of_state_applications_for_an_Article_V_Convention\" target=\"_blank\" rel=\"noreferrer noopener\">Wikipedia<\/a> has a chronological list.<\/p>\n\n\n\n<p>Biddulph mentions <a href=\"https:\/\/mandamus.net\/why-district-courts-do-not-have-jurisdiction-over-writs-of-mandamus-against-the-u-s\/\" target=\"_blank\" rel=\"noreferrer noopener\">filing<\/a> a <a href=\"https:\/\/www.law.cornell.edu\/wex\/mandamus\" target=\"_blank\" rel=\"noreferrer noopener\">mandamus<\/a> which was found <a href=\"https:\/\/legalknowledgebase.com\/why-is-the-writ-of-mandamus-unconstitutional\" target=\"_blank\" rel=\"noreferrer noopener\">unconstitutional<\/a> in&nbsp;Marbury v. Madison. Ohio Rep. Matt <a href=\"https:\/\/ohiohouse.gov\/members\/matt-huffman\/biography\" target=\"_blank\" rel=\"noreferrer noopener\">Huffman<\/a> goes on to say that states \u201cmake the rules for the federal government\u201d and are \u201cin effect like a board of directors that dictate policy, or should&#8230;to the elected federal officers\u201d&nbsp;(Hmmm, isn&#8217;t it the people through elected representation that dictate policy? Well, it used to be).&nbsp;What he goes on to describe, not everyone agreeing, is exactly what was addressed by&nbsp;Federalist No. <a href=\"https:\/\/founders.archives.gov\/documents\/Hamilton\/01-04-02-0248\" target=\"_blank\" rel=\"noreferrer noopener\">85<\/a>, which Mr. Biddulph had quoted as just calling for a convention. The full Federalist No. 85 should be read for a deeper understanding of what Publius was saying.<\/p>\n\n\n\n<p>Further discussion was held on what options could be explored to push a convention, one of which is focusing on the public because they just don\u2019t understand, and defining how money would be spent in emergencies.<\/p>\n\n\n\n<p>A more interesting discussion was about using a <a href=\"https:\/\/coloradofiscal.org\/wp-content\/uploads\/2025\/04\/2025-CFI-TABOR-Primer.pdf\">TABOR<\/a> or Swiss debt <a href=\"https:\/\/www.ntu.org\/foundation\/detail\/would-a-swiss-debt-brake-work-for-america-its-worth-a-shot\">brake<\/a> <a href=\"https:\/\/www.efd.admin.ch\/en\/the-debt-brake\">model<\/a> (5:30\u201d <a href=\"https:\/\/www.heritage.org\/debt\/event\/hitting-the-brakes-overspending-and-debt\">mark<\/a>) in the balanced budget amendment, the same language used by Rep. Shirts. It is unclear how this model would work as Switzerland has a <a href=\"https:\/\/www.avenir-suisse.ch\/en\/debt-brake\/\">different<\/a> government and tax <a href=\"https:\/\/menafn.com\/1110663925\/Value-Added-Tax-The-Swiss-Governments-All-Purpose-Tool\">structure<\/a> than the U.S.. The influence in thinking is already occurring as seen with language used by Rep. Shirts.<\/p>\n\n\n\n<p>Rep. Huffman begged the question, \u201cShould the states control policy of the federal government?\u201d And, if not agreeing with that, the Constitution and federalist papers should be read, and suggested there should be ongoing amendments to the Constitution.<\/p>\n\n\n\n<p>The point being, in the background there are other forces, at&nbsp;multiple <a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/10.1111\/pbaf.12390\">levels<\/a>, that this agenda for a convention is being pursued.&nbsp;The front of it is a simple resolution to call for a convention but the plan goes much deeper.<\/p>\n\n\n\n<p><strong>Reflections<\/strong><\/p>\n\n\n\n<p>Ironically,&nbsp;\u201dGerry also <a href=\"https:\/\/tenthamendmentcenter.com\/2025\/01\/24\/the-anti-federalist-views-of-elbridge-gerry\/\" target=\"_blank\" rel=\"noreferrer noopener\">warned<\/a> against putting blind trust in the delegates of the Philadelphia Convention, cautioning that even the most respected figures could make grave errors.\u201d Guess that supports the concern over a runaway convention. But more concerning is Idaho legislators following directions from someone who doesn&#8217;t understand Article V history, who has been involved in several different defunct organizations, who is tied to someone that uses his money to influence political landscapes, including Idaho, and whose ideologies may be perceived by some as extreme. Common today is so many political figures who behave in such unethical ways, heed should be paid to Gerry&#8217;s warning.<\/p>\n\n\n\n<p>There have been <a href=\"https:\/\/www.desmog.com\/2024\/10\/23\/trump-project-2025-tim-dunn-crownquest-convention-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">many<\/a> <a href=\"https:\/\/www.commoncause.org\/?s=convention+of+states\" target=\"_blank\" rel=\"noreferrer noopener\">articles<\/a> <a href=\"https:\/\/msmagazine.com\/2024\/03\/13\/republicans-congress-constitutional-convention\/\" target=\"_blank\" rel=\"noreferrer noopener\">written<\/a> about this agenda, maybe some of which are <a href=\"https:\/\/www.desmog.com\/2025\/06\/02\/map-70-percent-trump-cabinet-tie-project-2025-heritage-afpi-convention-states-dunn-doge\/\" target=\"_blank\" rel=\"noreferrer noopener\">outlandish<\/a>, but others exploring the issue more <a href=\"https:\/\/www.congress.gov\/crs_external_products\/R\/PDF\/R42592\/R42592.9.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">broadly<\/a> and more&nbsp;<a href=\"https:\/\/scholarship.law.wm.edu\/cgi\/viewcontent.cgi?article=2118&amp;context=wmborj\" target=\"_blank\" rel=\"noreferrer noopener\">thoughtfully<\/a>. But, perhaps reading the history of the Founders, their ideas and thoughts that were debated, and considering their wisdom should be the way to understand this issue. This is not an issue in which to become enamored or responded to emotionally. Every aspect should be given careful thought, the Founders providing the best understanding.
