Little, the landmark challenge to Idaho\u2019s Fairness in Women\u2019s Sports Act. Judge Nye granted Idaho\u2019s motion to strike the dismissal notice, keeping the case pending in district court while it awaits potential review by the U.S. Supreme Court.<\/p>\n\n\n\n<p>Judge Nye found that Hecox\u2019s dismissal&nbsp;<em>\u201ccontravenes the stay currently in place and flaunts principles of equity and fairness and is, thus, void.\u201d<\/em>&nbsp;Nye emphasized that after years of litigation,&nbsp;<em>\u201c[Idaho] has a fair right to have its arguments heard and adjudicated once and for all.\u201d<\/em>&nbsp;And that,&nbsp;<em>\u201c[T]he Court feels {Hecox\u2019s} mootness argument is, as above, somewhat manipulative to avoid Supreme Court review and should not be endorsed.\u201d<\/em><\/p>\n\n\n\n<p>\u201cFrom day one in office, defending this law has been a top priority because Idaho\u2019s daughters deserve fair competition based on biological reality,\u201d&nbsp;<strong>said Attorney General Labrador.<\/strong>&nbsp;\u201cThe district court has ruled that after years of litigation, Idaho has earned the right to present our case to the nation\u2019s highest court. This decision keeps our lawsuit alive, and I won\u2019t stop until women and girls are safe to compete, participate, and excel in competitive sports.\u201d<\/p>\n\n\n\n<p>Hecox sued Idaho in 2020 to block enforcement of the Fairness in Women\u2019s Sports Act, which prevents biological males from competing in women\u2019s athletics. When Attorney General Labrador took office in January 2023, he made defending the law a key priority and appealed the case up to the U.S. Supreme Court. In July, the Supreme Court agreed to review Idaho\u2019s case. Both parties agreed to stay all court proceedings while awaiting the Supreme Court\u2019s decision.<\/p>\n\n\n\n<p>In September, Hecox filed a notice attempting to voluntarily dismiss the entire lawsuit in federal district court. Idaho objected, arguing the dismissal violated the agreed-upon stay, and asked Judge Nye to strike the dismissal notice.<\/p>\n\n\n\n<p>The ruling keeps Idaho\u2019s case active in federal district court. However, Hecox also filed a separate \u201csuggestion of mootness\u201d with the U.S. Supreme Court asking them to dismiss the case.
