Dear Honorable Supreme Court Justices:

I am writing you regarding your pending opinion on whether there is a Constitutional “right” to abortion in the United States.

The U.S. Constitution was written for We the People to understand and obey. You have been placed according to the will of God in a position of authority to deliver justice on behalf of our nation’s citizens (Romans 13:1 and Exodus 18:19-23). I urge you to make your determination with reverence for God and His commands, including the commandment written above the Supreme Court bench: “You shall not commit murder” (Deuteronomy 5:17).

Some of you have already correctly discerned that the Constitution contains no “right” to abortion under the concept of “privacy” or anywhere else, since the word abortion is not even mentioned. Normally a circumstance outside the authority of the United States would be reserved to the States or the people, as per the 10th Amendment. It appears a majority of the Court is preparing to reserve the decision to allow or restrict abortion to the states.

There is, however, an insurmountable problem with that position, for the U.S. Constitution forbids the states from depriving any person of life without due process of law, or denying any person the equal protection of the laws (14th Amendment, Section 1).

It is now clearly understood from ultrasound imaging that an unborn child is a person at an early stage of development. He or she is not a blob of tissue, a tadpole, a fish, or any other evolving organism. Thousands of years before ultrasound was invented, God already told us that He knows us in the womb (see Psalm 139:13-16 and Jeremiah 1:5). God even names His unborn children before their birth (Luke 1:13 and 31) and gives them a call to serve Him (Jeremiah 1:4-5 and Judges 13:5).

Abortion unjustly takes the life of an unborn child made in the image of God and is therefore murder. Under the Roe v. Wade decision the 1972 Supreme Court created a “right” to murder millions of unborn children. Those defenseless, innocent children received no due process or equal protection under the law.

An unborn person currently has no protection under the law from the procedure of abortion; but if a person kills a pregnant woman, the assailant is charged with two counts of murder. The latter determination is correct and your ruling on Roe v Wade MUST reflect the clear meaning of the 14th amendment and the historic interpretation/application of that amendment from its date of ratification until 1972 (i.e., national prohibition of abortion).

The states have NO right to permit the slaughter of defenseless unborn children under cover of state or federal law when the supreme law of the land AND the Supreme Judge both declare the states shall not deprive a person of life without due process.

The blood of every child aborted in the future will be on your hands if you fail to deliver long-awaited justice to the unborn when you have the power to do so.

Women generally have the choice not to become pregnant (except in cases of rape or incest). [Note: Even under “un-chosen” circumstances of pregnancy following rape or incest, God created that child and ordained that he or she would exist. There are many testimonies of adults conceived in rape or incest who are grateful their mothers chose life.] However, once a woman conceives, the mother has the moral responsibility to bear the child and raise him or her, or give the child to adoptive parents. Ending abortion in the United States not only protects the babies’ lives, it prevents mothers and doctors from committing pre-meditated murder.

Proverbs 24:10-12 says:

“If you falter in times of trouble, how small is your strength!
Rescue those being led away to death; hold back those staggering toward slaughter.
If you say, ‘But we knew nothing about this,’ does not He who weighs the heart perceive it?
Does not He who guards your life know it?
Will He not repay each person according to what he has done?”

Please have the courage to defend the defenseless, innocent children of our nation and set our nation on a path of righteousness. Please issue a judgment that reverses Roe v. Wade entirely and upholds the 14th amendment by prohibiting the states or Congress from enacting laws that deprive an unborn child of life.

“Righteousness exalts a nation, but sin is a disgrace to any people” (Proverbs 14:34).

Sincerely,
Evalyn Bennett
